Terms
Terms of service
The terms for using SuperScreencast and this website — short, plain, and in plain sight.
§1 · Scope
These terms govern the use of the SuperScreencast application, this website, and any paid offering, and are concluded between you and Merola Software & Services, Wartauweg 19, 8049 Zurich, Switzerland (see the imprint). By downloading or using SuperScreencast, you accept these terms.
§2 · What the terms cover
- SuperScreencast Community — the complete SuperScreencast application for capture, composition, the virtual camera, and recording. Free of charge, including streaming.
- SuperScreencast Pro — a perpetual license adding cinematic zoom, local transcription and subtitles, and speaker notes to the same application. [exact Pro entitlements pending final pricing — see pricing page]
The three output lanes (virtual camera, recording, streaming) share one composition; these terms apply to the product as a whole regardless of which lanes you use.
§3 · License and source code
The SuperScreencast source code is developed in the open and made available under the license published with the source in its repository; that license governs the code itself. These terms govern your use of the packaged application, this website, and Pro services. Where the code license and these terms overlap, the code license prevails for the source code.
§4 · Acceptable use
- You are the broadcaster. Content you record or stream, and the rights to it, are your responsibility. Make sure you have the consent of everyone appearing in your recordings or streams where the law requires it.
- You hold your credentials. Streaming uses a stream key from a file on your machine. Keep that file secure; do not broadcast content you are not authorised to broadcast.
- No misuse of the service. Do not use this website or Pro services to harm the service, other users, or third parties, or to circumvent licensing.
§5 · Pro licenses
Pro is offered as a perpetual license with a one-time payment. [price, update period, and payment methods pending final pricing] Minor updates are guaranteed for one year; the license keeps working afterwards. Consumers may additionally have statutory withdrawal rights.
§6 · Prices and taxes
Prices are stated on the pricing page and include statutory VAT where applicable. [VAT treatment per customer jurisdiction — to be completed with the payment provider]
§7 · No warranty
SuperScreencast is provided as-is. To the extent permitted by law, we disclaim warranties of uninterrupted operation, fitness for a particular purpose, and non-infringement. Capture behaviour depends on your desktop environment, display server, and audio system; limitations of specific backends are documented in the product. Streaming quality and availability depend on your network and your streaming destination, which we do not operate.
§8 · Liability
To the extent permitted by Swiss law, our liability is limited to direct damages caused by intent or gross negligence. Liability for slight negligence, for indirect or consequential damages, and for lost data or lost revenue is excluded. You remain responsible for backing up your recordings and configuration.
§9 · Changes
We may develop and change SuperScreencast over time, including discontinuing features, and we may update these terms. Material changes to the terms will be announced on this page; continued use after the announcement constitutes acceptance. If you do not agree with a change, your remedy is to stop using the service.
§10 · Governing law and jurisdiction
These terms are governed by Swiss substantive law, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Zurich, Switzerland, unless mandatory consumer-protection provisions grant you a different forum.
